REQUISITOS DE LAS VIVIENDAS DE ALQUILER VACACIONAL

El Decreto 28/2016, de 2 de febrero regula las viviendas de uso turístico en Andalucía, por lo que los propietarios que quieran destinar sus inmuebles al alquiler vacacional deben inscribir su vivienda en el Registro de Turismo de Andalucía, e incluir el código de registro en los anuncios de la misma.

Este trámite es obligatorio para el inicio de actividad como vivienda de fines turísticos, y en caso de incumplimiento se considerará a la vivienda como clandestina, tipificado como infracción grave o muy grave, con sanciones de hasta 150.000 €.

Asimismo, las viviendas deben cumplir con los siguientes requisitos, recogidos en el artículo 6 de dicho Decreto:

  • La vivienda debe disponer de Licencia de Primera Ocupación, y cumplir con las condiciones técnicas y de calidad exigibles a las viviendas.
  • La capacidad máxima de la vivienda no puede superar las 15 plazas.
  • Las habitaciones deben tener ventilación directa al exterior o a patios, y algún sistema de oscurecimiento de ventanas.
  • La vivienda debe estar suficientemente amueblada y dotada de los aparatos y enseres necesarios para su uso inmediato, y acorde al número de plazas que disponga.
  • Disponer de aparatos fijos de refrigeración en habitaciones y salones en los meses de mayo a septiembre, y calefacción de octubre a abril.
  • Disponer de Botiquín de Primeros Auxilios.
  • Disponer de Hojas de Quejas y Reclamaciones, y un cartel anunciador de las mismas en lugar visible dentro de la vivienda.
  • Disponer de información turística, en soporte físico o electrónico, incluyendo lugares de ocio, restaurantes y cafeterías, comercios y tiendas de alimentos, aparcamientos próximos, servicios médicos de la zona, medio de transporte urbano, plano de la localidad y guía de espectáculos.
  • Realizar servicio de limpieza en la vivienda a la entrada y salida de los inquilinos.
  • Disponer menaje del hogar, así como de ropa de cama y baño con un juego de reposición.
  • Disponer de instrucciones para el uso de los electrodomésticos y aparatos.
  • Información sobre las normas relativas al uso de las instalaciones, dependencias, y equipos de la vivienda, así como la admisión de mascotas, restricciones para personas fumadoras y zonas de uso restringido.
  • Facilitar un número de teléfono para incidencias, con disponibilidad de 24 horas.

Por otro lado,  los titulares de las viviendas dedicados a esta actividad están obligados a comunicar el Parte de Entrada de viajeros en la Comisaría de Policía, en el plazo de 24 horas, indicando los datos de identificación del viajero, los del titular de la vivienda y la fecha de entrada. Este documento debe ajustarse a un modelo ya existente, que se conservará durante 3 años y formará parte del Libro Registro de los inquilinos, para exhibirlo a las fuerzas de seguridad en caso de que lo requieran.

Decree 28/2016, of 2nd of February regulates the leases for touristic purposes in Andalucía, and owners carrying out this activity are obliged to register the property in the Andalusian Tourism Registry, and the registration code should be included in all the advertisements.

The exploitation of the property without prior registration in the Junta de Andalucía will be considered as clandestine, and will constitute a serious infringement with fines up to 150.000 €.

In addition and according to Article 6, the property should meet the following requirements:

  • To have the First Occupation License and to comply with the technical and quality requirements.
  • The property can´t be inhabited with more than 15 people.
  • The rooms of the property must have direct ventilation to the outside or to patios, and to have some system for darkening the windows.
  • The residential dwelling must be furnished and equipped with necessary appliances and equipment for an immediate use.
  • When the lease period comprises from May to September, the properties must have refrigeration as fixed elements in the rooms and lounges. When the period includes the months from October to April, they must have heating.
  • To have a First Aid Kit.
  • To have accessible Complaint Forms placed visibly inside the property.
  • To have touristic information about the area including leisure, restaurants and cafes, shops and food stores, parking, medical services, urban transport, local map and local events guide).
  • To have a cleaning service before the check in and after the check out of the tenants.
  • To have bed linen, lingerie, household goods, etc, depending on the time occupation of the residential dwelling and also having a replacement of these.
  • To have the operating instructions for appliances or other devices that they require for a correct usage.
  • To inform about the use of the installations and equipment, the admission or existing pets in the house, smoking restrictions or restricted zones in the house.
  • To provide guests with a telephone number for emergencies (24 hr) and solving any queries or incidents relating to the house.

Moreover, these properties submit the Entry Document in the Police Office, in a 24 hour period from the delivery of the property, including the tenant´s identification information, the owner of the property and the date of entry. This document should be kept for a 3 year period and should follow a fixed format, and it will be part of the Tenant´s Registration Book, to be shown to the  authorities if required.
